Posterior a la Sentencia del Tribunal Supremo de 3 de octubre de 2018

La Sentencia del Tribunal Supremo de 3 de octubre de 2018, dictada en recurso de casación 4483/2017, confirma la posición adoptada por el Tribunal Superior de Justicia de Madrid y resuelve que las prestaciones públicas por maternidad percibidas del INSS están exentas en el IRPF, al entender que pueden incardinarse en el supuesto previsto en el párrafo tercero letra h del artículo 7 de la Ley del IRPF, cuando dispone que “igualmente estarán exentas las demás prestaciones públicas por nacimiento, parto o adopción múltiple, adopción, hijos a cargo y orfandad”.

Anterior a la Sentencia del Tribunal supremo de 3 de octubre de 2018

De nuevo el Tribunal Superior de Justicia de Madrid, en su Sentencia de 29 de junio de 2017, ha vuelto a declarar exenta en el IRPF la prestación por maternidad percibida del INSS, como ya lo hizo en su anterior Sentencia de 6 de julio de 2016. Esta nueva sentencia deja otra vez la puerta abierta para que aquellos contribuyentes, que no habiéndolo hecho todavía y encontrándose en la misma situación, puedan reclamar las cantidades indebidamente satisfechas.


Las alternativas para ello pueden ser diferentes según se trate de contribuyentes con domicilio fiscal en Madrid o fuera de dicha Comunidad, Sin duda, para los domiciliados en Madrid la vía procesal más rápida para poder obtener un resultado similar a la de la contribuyente cuya reclamación dio origen a la Sentencia del TSJ de Madrid, es la solicitud de extensión de efectos de Sentencias en materia tributaria, contemplada en el art. 110 de la LJCA. Sin embargo, los contribuyentes domiciliados fuera de la Comunidad de Madrid deberán solicitar la rectificación de su autoliquidación o autoliquidaciones de IRPF, con devolución de ingresos indebidos.
