El pasado  5 de junio de 2018, se publicó en el DOUE la Directiva 2018/822 del Consejo de 25 de mayo de 2018, que modifica la Directiva 2011/16/UE por lo que se refiere al intercambio automático y obligatorio de información en el ámbito de la fiscalidad en relación con los mecanismos transfronterizos sujetos a comunicación de información, comúnmente conocida como Directiva de Intermediarios Fiscales o DAC 6.

 

En base a esta Directiva, que deberá ser traspuesta a las normativas internas no más tarde del 31 de diciembre, se obliga a aquellos intermediarios fiscales (abogados, economistas, asesores fiscales, entidades de inversión, bancos) que diseñen y promuevan esquemas transfronterizos de planificación fiscal agresiva para sus clientes, ya sean esquemas genéricos para la comercialización, o diseñados a medida para un supuesto en particular, a informar a la administración tributaria. Posteriormente, las administraciones tributarias intercambiarán la información, de manera automática, con el resto de los Estados miembros. La Directiva será de aplicación a partir del 1 de julio de 2020.
